Terms of service

1. Who we are

These Terms and Conditions of Sale govern purchases made on atelier23.store. The seller is Andrei Kostenko, individual entrepreneur trading as ATELIER 23, NIF 311571832, Avenida da Liberdade 110, office 209, 1269-046 Lisboa, Portugal, info@atelier23.store, +351 912 204 778.

The Terms are available in English and Portuguese. Both versions have the same content; you may rely on the version in your language.

2. Scope

These Terms apply to sales to consumers, meaning natural persons buying for purposes outside their trade or profession, and, where applicable, to other customers. Nothing in these Terms limits the rights that consumers have under mandatory law, in particular Decree-Law 24/2014 on distance contracts and Decree-Law 84/2021 on the legal guarantee.

Made to measure garments ordered at our Lisbon atelier are also subject to the conditions agreed in writing at the consultation.

3. Products

We sell three kinds of products, and each product page says which one it is:

  • In-stock pieces (knitwear and other ready-to-wear items), dispatched within 2 business days.
  • Made to order in a standard size (suits, tuxedos, jackets, shirts, vests): you choose a size from our size chart and we make the garment after you order; it is ready in 4 weeks.
  • Made to measure: garments cut to your own measurements and specifications after a consultation at the atelier.

Photographs and colours are shown as accurately as possible, but screens differ and natural cloth varies slightly between batches. Small differences of shade or texture inherent to natural materials are not a defect.

Please check our size chart before ordering a standard size. If you are unsure, write to us before you order and we will help you choose.

4. Prices and payment

Prices are shown in euros and are final prices. ATELIER 23 is exempt from VAT under Article 53 of the Portuguese VAT Code, so no VAT is added. Shipping is free.

For deliveries outside the European Union, import duties and taxes charged by the destination country are not included and are paid by the recipient.

Payment is made at checkout with the methods shown there. Your card is charged when the order is placed.

If a price is shown with an obvious error (for example a price far below the real value), we will tell you before dispatch and you may confirm the order at the correct price or cancel it with a full refund.

5. How the contract is formed

The order is placed when you click the payment button at checkout. The contract is concluded when we send you the order confirmation email. We keep a record of the contract and send you its terms by email.

We may refuse or cancel an order before dispatch, with a full refund, if the product is no longer available, if the payment is not authorised, or if there are reasonable signs of fraud.

6. Delivery

Delivery times are set out in our Shipping Policy and on each product page. For made-to-order garments the agreed time is 4 weeks from the order and no more than 6 weeks. If we cannot meet the agreed date, we will tell you and propose a new one; if you do not accept it, you may cancel and receive a full refund.

The risk of loss or damage passes to you when you, or a person you nominate other than the carrier, take physical possession of the goods.

7. Right of withdrawal

As a consumer you may withdraw from a distance purchase within 14 days of receiving the goods, without giving a reason. How to do this, and the exceptions, are explained in our Returns and Withdrawal Policy.

Under Article 17(1)(c) of Decree-Law 24/2014, there is no right of withdrawal for goods made to the consumer's specifications or clearly personalised, including made to measure garments and garments altered or monogrammed at your request.

8. Legal guarantee

All goods are covered by the legal guarantee of conformity under Decree-Law 84/2021: 3 years from delivery. If a defect appears, write to us and we will repair or replace the item; where that is not possible, you may ask for a price reduction or end the contract, under the terms of the law.

The guarantee does not cover normal wear, damage caused by use contrary to the care instructions on the label or product page, accidents, or alterations made by third parties.

9. Alterations and fittings

Made to measure garments include the fittings agreed at the consultation. Corrections needed to reach the agreed fit are made free of charge at the atelier. Later changes requested by the client, for example after a change of weight, are quoted separately.

10. Liability

We are liable in accordance with the law. We are not liable for indirect loss or for delays caused by events beyond our reasonable control, such as carrier failures, strikes or natural events, provided we inform you promptly. Nothing in these Terms excludes or limits liability for death or personal injury, for intent or gross negligence, or any other liability that cannot be limited by law.

11. Intellectual property

The texts, photographs, logos and designs on this site belong to ATELIER 23 or are used with permission. They may not be copied or used commercially without our written consent.

12. Personal data

We process personal data in accordance with the General Data Protection Regulation and our Privacy Policy.

13. Complaints and dispute resolution

Write to info@atelier23.store and we will reply within 5 business days. You may also use the electronic complaints book (Livro de Reclamações Eletrónico).

In the event of a dispute, a consumer may use an alternative dispute resolution entity: the Centro de Arbitragem de Conflitos de Consumo de Lisboa (www.centroarbitragemlisboa.pt) or the Centro Nacional de Informação e Arbitragem de Conflitos de Consumo, CNIACC (www.arbitragemdeconsumo.org). More information at the Consumer Portal, www.consumidor.gov.pt.

14. Applicable law

These Terms are governed by Portuguese law. If you are a consumer habitually resident in another country, you also keep the protection of the mandatory rules of that country. Disputes are settled by the competent courts under the applicable law, without prejudice to the consumer's right to bring proceedings in the courts of their place of residence.

15. Changes

We may update these Terms. The version in force on the date of your order applies to that order. Last updated: 22 September 2026.
